Brand New or Resale Condo in Pattaya? The Real Costs, Risks and Rewards

Almost every condo search in Pattaya comes down to one decision: buy brand-new (or off-plan), or buy a resale unit? Both can be the right answer. It depends on your priorities, your timeline and how you weigh risk against value. This buyer-first comparison from Pearl Property Pattaya covers the factors that actually change the outcome.

Foreign Quota: Often the Deciding Factor

Thai law lets foreigners together own up to 49% of a building's saleable area as freehold. In a new project, that foreign quota is usually still open, so securing a freehold unit in your own name is straightforward. In an older, popular resale building, the foreign quota may already be full, and only units that are already foreign-owned can pass to another foreigner.

Do not work around a full quota with a nominee or Thai-company structure. Enforcement against nominees has been stepped up; see the nominee crackdown. Confirm the quota status of the specific unit first; see what to check before you pay any deposit.

Price per Square Metre

Resale units almost always cost less per sqm than a comparable new launch in the same area, and in today's buyer-friendly market many trade below the asking price. New builds command a premium for modern design, warranties and facilities. Don't compare headline prices. Compare the price per sqm of genuinely like-for-like units (same area, similar floor, comparable view) to see what the premium actually buys you. Current price levels are in what an apartment costs in Pattaya and in the live condos for sale.

Move-In Timing and Off-Plan Risk

A resale unit is a known quantity. You can live in it or rent it out immediately, with no construction risk. An off-plan purchase means waiting through the build, often at the lowest entry price and with staged payments. The trade-off is risk: you rely on the developer to deliver on time and to spec, and your instalments usually go directly to the developer. To reduce the risk:

  • check the developer's completed track record, and ask to see at least one finished, handed-over project;
  • read the contract's delivery and refund clauses;
  • choose a payment plan weighted towards completion.

See is off-plan worth the risk?

Building Condition and the Sinking Fund

This is where resale buyers get caught out. A cheap unit is not actually cheap if the building has:

  • a depleted sinking fund;
  • deferred maintenance;
  • a weak juristic person (the management body).

You may face special levies or rising common fees later. For any resale, request the juristic person's financial statements and the sinking-fund balance, and check how the monthly common fee has developed. New buildings start with a fresh sinking fund; then the question is how well it is managed after handover. See condo fees in Pattaya.

Rental Potential

A resale unit can produce rent from day one, and you can see its rental history. A new unit rents well when it is finished, but so do all the other new units completing in the same building at the same time, which can push rents down in the first year. Either way, plan with net figures after fees, furnishing and vacancy. Remember that stays under 30 days need a hotel licence under the Hotel Act. See what Pattaya tenants actually want.

Inspection and Due-Diligence Checklist

  • Resale:
    • inspect the actual unit for water damage, air-conditioning age and general wear;
    • check that the title deed matches the seller;
    • get the debt-free letter confirming common fees are paid before transfer.
  • New / off-plan:
    • verify the developer's track record, permits and EIA approval;
    • have an independent lawyer review the sale and purchase agreement;
    • confirm the payment schedule and completion terms;
    • inspect the unit at handover.
  • Both:
    • confirm the foreign quota;
    • agree who pays which transfer costs (the 2% transfer fee is usually split, and the seller's taxes are legally the seller's);
    • send the purchase money from abroad in foreign currency, and keep the FET form.

Which Should You Buy?

Lean new / off-plan if you want freehold quota certainty, modern layouts and facilities, and staged payments, and you can wait for completion. Lean resale if you want a lower price per sqm, immediate use or rental income, an established location and a unit you can physically inspect, provided the building is well managed. In practice, the best decision comes from running the numbers on two specific units, one new and one resale, side by side.
