Can You Rent Out a Pattaya Condo on Airbnb? Rules, Building Policies and Safer Alternatives

A Pattaya condo may look like an ideal holiday rental. Before accepting weekend bookings, though, owners need to check two separate things: Thai accommodation law and the rules of their particular building. An Airbnb listing does not settle either question.

The key distinction: short stays and monthly rentals

Thailand’s Hotel Act generally requires a licence to operate paid temporary accommodation. It excludes accommodation established only for stays charged monthly or longer. That is why owners often use a one-month minimum for condo rentals.

The distinction is about the real arrangement, not just the wording of a listing. Calling a three-night stay a “monthly rental” does not make it one. Daily and weekly bookings in an ordinary residential condo can be treated as unlicensed hotel activity. In 2025, Thailand’s Department of Provincial Administration specifically warned against daily condo rentals and said enforcement would continue nationwide. The penalties can be substantial: the Hotel Act provides for up to one year’s imprisonment, a fine of up to ฿20,000, or both, plus a continuing daily fine of up to ฿10,000 for operating a hotel business without a licence. Source: Hotel Act, Sections 15 and 59.

Does the small-accommodation exception help condo owners?

A 2023 regulation allows certain small accommodation establishments—no more than eight rooms and 30 guests in total—to fall outside the Hotel Act’s definition of a hotel. This is not an automatic Airbnb exemption. The premises must go through the required notification and inspection process and receive written acknowledgement from the registrar. Other building and condominium requirements still matter. Source: 2023 regulation in the Royal Gazette.

An owner should therefore avoid assuming that a single condo unit qualifies simply because it has fewer than eight rooms. Anyone considering short-stay operation needs property-specific advice and confirmation from the relevant authorities before advertising it.

Your building’s rules matter too

Even a genuine monthly rental must comply with the condominium’s regulations. Thailand’s Condominium Act provides for rules governing the use of private units and common areas. In practice, a Pattaya building may set requirements for minimum lease terms, tenant registration, access cards, parking, facilities and move-in procedures.

Before buying a condo for rental income—or publishing a listing—ask the juristic office for the current registered regulations and written rental procedures. Check whether the building permits the intended lease length, how tenants receive access, and whether any owner or tenant documents must be submitted. A sales agent’s assurance that “other owners use Airbnb” is no substitute for those documents.

Safer ways to earn rental income

For many residential condo owners, a genuine monthly or longer lease is a more straightforward option, provided the building allows it. A clear written agreement should state the term, rent, deposit, utility charges, occupancy limits and responsibility for damage.

Why I recommend longer-term rentals

My recommendation is to rent for the long term. At Pearl Property, we handle only leases of six months or longer. This is our business policy, separate from the Hotel Act’s monthly-rental distinction.

With frequent tenant changes, a condo typically sees more wear from repeated move-ins and move-outs. Every new stay also brings another check-in, key handover, building registration and, where applicable, immigration reporting. In my view, the somewhat higher rent that short stays may bring usually does not justify that extra work and wear. For most owners, it simply is not worth it.

A stable tenant and a longer lease make the rental easier to manage and the income more predictable. Owners can market to people seeking an extended Pattaya stay rather than relying on a constant stream of holiday bookings.

If short stays are central to the investment plan, look for a property whose documented legal status and building rules support that use. Verify the relevant permissions yourself before purchase. A property described in marketing as a “condotel” should receive the same document check; the label alone proves nothing.

Owners also need to handle obligations that apply to lawful rentals. Where a foreign national stays, Thailand’s Immigration Bureau says the house owner, landlord or other responsible host must submit a TM.30 residence notification within 24 hours of arrival. Rental income may also be taxable. Sources: Immigration Bureau and Revenue Department.

The practical answer

Can you rent out a Pattaya condo on Airbnb? The platform itself is not the deciding factor. A genuine monthly rental may be possible if the building permits it and the owner meets the applicable requirements. Daily or weekly stays in an ordinary residential condo carry serious legal risk without the appropriate approvals.

Before counting on rental returns, check the lease model, obtain the building rules in writing and verify any claimed short-stay permissions with a qualified local adviser. If you want a lower-turnover investment, plan around a longer lease from the start.
