Buying a villa is legally different from buying a condo, and it's the single most important thing to understand before you fall in love with a Huai Yai pool villa. Thai law reserves land ownership for Thai nationals — foreigners cannot hold the land under a villa freehold, unlike a condo unit, which foreigners can own outright within a building's foreign quota.
In practice, foreign buyers structure a Huai Yai villa purchase one of three ways: a registered long-term lease on the land (typically 30 years, renewable, with the house structure itself owned freehold); a properly set up Thai limited company that holds the land, with the foreigner as a minority shareholder and director; or, less commonly, owning the house structure separately from the land via a superficies or usufruct-style right. Whichever route you choose, always confirm the land carries a Chanote title — Thailand's strongest, most freely transferable land title — before signing anything.
